These Terms and Conditions (“Terms”) govern the provision and use of broadband internet and related services offered by SWIBI AIRNET BROADBAND SERVICES PVT LTD., operating as Swibi Fibernet (“Swibi”, “we”, “our”, or “us”).

By applying for, activating, renewing, paying for, or continuing to use our services, the subscriber (“Customer”, “Subscriber”, “you”, or “your”) agrees to these Terms.

1. Service Eligibility

Customers must provide accurate and complete information during registration and connection activation.

Customers must provide identity, address, KYC, and other documents where required under applicable law, regulations, or company procedures.

The broadband connection shall be installed and used only at the registered service location unless otherwise approved by Swibi Fibernet.

2. Service Availability

Broadband services are subject to:

  • Network feasibility
  • Fibre/cable availability
  • Equipment availability
  • Technical feasibility
  • Network capacity
  • Right-of-way and infrastructure availability
  • Local permissions where applicable
  • Force majeure and circumstances beyond our reasonable control

Submission of a connection request or payment does not necessarily guarantee service availability until technical feasibility is confirmed.

3. Installation and Activation

Installation charges, security deposits, equipment charges, activation fees, or other applicable charges may be collected depending on the selected plan or connection type.

Installation timelines are estimates and may vary depending on technical feasibility, fibre availability, permissions, weather, infrastructure conditions, or other circumstances.

4. Broadband Plans

Internet speed, data allowance, validity, Fair Usage Policy (FUP), pricing, OTT benefits, static IP services, and other features depend on the customer’s selected plan.

Plan details communicated at the time of subscription or displayed through official Swibi Fibernet channels shall apply to the relevant subscription.

We may introduce, discontinue, or modify plans, subject to applicable regulatory requirements.

5. Internet Speed

Broadband speeds advertised with a plan generally represent the applicable plan speed or maximum configured speed and should not be interpreted as a guarantee that every website, application, or internet destination will continuously operate at that exact speed.

Actual performance may vary due to factors including:

  • Wi-Fi coverage
  • Customer router capabilities
  • Customer device capabilities
  • Number of connected devices
  • LAN/Wi-Fi configuration
  • Network congestion
  • Third-party server capacity
  • Internet routing
  • International bandwidth conditions
  • Website/application performance
  • Fibre or equipment faults
  • Interference affecting wireless connectivity

For accurate troubleshooting, customers may be requested to perform a speed test using a wired Ethernet connection to a compatible device.

6. Wi-Fi Performance

Internet connection speed and Wi-Fi speed are not necessarily the same.

Wi-Fi coverage and performance depend on the router, building layout, walls, distance, interference, frequency band, customer devices, and other environmental factors.

Additional access points, mesh Wi-Fi systems, or networking equipment may be required for larger premises and may involve additional charges.

7. Billing and Payments

Customers must pay all applicable subscription, installation, equipment, usage, and other charges by the applicable due date.

Services may be suspended or restricted if payment is not received within the applicable billing or renewal period.

Applicable taxes and statutory charges shall be charged as required by law.

Customers are responsible for verifying their selected plan and payment amount before completing a transaction.

8. Prepaid Services

For prepaid broadband plans:

  • Services are generally provided for the purchased validity period.
  • Renewal should be completed before or upon expiry to continue service.
  • Unused validity or benefits may expire at the end of the applicable subscription period unless otherwise specified.
  • Renewal of a plan constitutes acceptance of the applicable plan terms.

9. Refunds

Payments successfully applied to an activated or renewed broadband plan are generally non-refundable once the applicable service period has commenced, except where required by law or expressly approved by Swibi Fibernet.

Where a new connection cannot be provided due to technical infeasibility after payment, eligible amounts may be refunded after deduction of any applicable charges for work, equipment, or services already provided, subject to company policy and applicable law.

Duplicate or incorrect payments should be reported to customer support with transaction details for verification.

10. Customer Equipment

Depending on the connection, equipment may include:

  • ONT/ONU
  • Wi-Fi router
  • Power adapter
  • Fibre accessories
  • Other network equipment

Equipment may be sold, rented, provided on refundable deposit, or supplied for use during the subscription period depending on the applicable offer.

Ownership of equipment shall be determined by the terms under which it was supplied.

Equipment owned by Swibi Fibernet must be returned in reasonable condition upon termination where required.

Charges may apply for equipment that is lost, damaged, tampered with, or not returned.

11. Customer Responsibilities

Customers must:

  • Use the service lawfully
  • Protect account and Wi-Fi credentials
  • Maintain suitable power supply for networking equipment
  • Avoid tampering with fibre or network equipment
  • Provide reasonable access to authorised technical personnel when necessary
  • Immediately report suspected unauthorised use
  • Ensure that users of the connection comply with applicable laws and these Terms

12. Prohibited Use

Customers must not use Swibi Fibernet services for activities prohibited by applicable law.

Prohibited activities include, without limitation:

  • Unauthorised access to networks or systems
  • Distribution of malware
  • Network attacks
  • Fraudulent activities
  • Illegal interception
  • Deliberate disruption of networks
  • Spam or abusive traffic
  • Hosting or distributing unlawful material
  • Using the connection in violation of applicable telecommunications, cybersecurity, or other laws

We may restrict or suspend services where reasonably necessary to protect our network, customers, or legal obligations.

13. Resale and Unauthorised Redistribution

Unless the customer has a written commercial agreement permitting it, residential broadband connections must not be commercially resold, redistributed, or used to provide internet service to unrelated third parties.

Customers requiring commercial redistribution or specialised connectivity should contact Swibi Fibernet for an appropriate business service.

14. Network Management

Swibi Fibernet may undertake reasonable network-management measures to:

  • Maintain network stability
  • Protect network security
  • Prevent abuse
  • Manage congestion
  • Perform maintenance
  • Diagnose faults
  • Improve service quality
  • Comply with regulatory or legal requirements

Such measures will be implemented in accordance with applicable requirements.

15. Service Interruptions

Internet service may occasionally be interrupted due to:

  • Fibre cuts
  • Equipment failure
  • Power failure
  • Upstream provider failure
  • Maintenance
  • Network upgrades
  • Natural disasters
  • Severe weather
  • Government or regulatory directions
  • Damage to infrastructure
  • Events beyond our reasonable control

We will make reasonable efforts to restore affected services as quickly as practicable.

16. Planned Maintenance

Where reasonably practicable, customers may be informed about significant planned maintenance through SMS, WhatsApp, email, telephone, website notices, or other available communication channels.

Emergency maintenance may be carried out without prior notice where necessary to protect the network or restore service.

17. Complaint and Technical Support

Customers experiencing connectivity problems should contact Swibi Fibernet support and provide relevant details, including their customer/account information and description of the issue.

Customers should provide reasonable cooperation for remote diagnostics or an onsite visit where required.

Resolution times may vary depending on the nature and location of the fault.

18. Temporary Suspension

Swibi Fibernet may suspend or restrict a connection in circumstances including:

  • Non-payment
  • Suspected fraud
  • Security threats
  • Network abuse
  • Violation of these Terms
  • Unauthorised redistribution
  • Legal or regulatory directions
  • False or invalid customer information

Services may be restored after the relevant issue has been resolved and any applicable charges have been paid.

19. Termination

Customers may request termination of their broadband service by contacting Swibi Fibernet.

Outstanding dues must be settled before account closure.

Where company-owned equipment has been supplied, the customer may be required to return such equipment.

Swibi Fibernet may terminate services for serious or repeated violations of these Terms, subject to applicable law and regulatory requirements.

20. Third-Party Services

Some plans may include or provide access to third-party services such as OTT platforms, applications, content services, payment gateways, or other digital services.

Such services are governed by the respective third party’s terms and policies.

Availability, content, features, pricing, or eligibility of third-party services may change independently of Swibi Fibernet.

21. Limitation of Responsibility

To the extent permitted by applicable law, Swibi Fibernet shall not be responsible for losses caused solely by circumstances outside our reasonable control, including failures of third-party websites, applications, customer devices, customer Wi-Fi networks, upstream providers, power supply, or force majeure events.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.

22. Privacy

Personal information associated with broadband services will be handled in accordance with the Swibi Fibernet Privacy Policy and applicable law.

23. Changes to Terms

Swibi Fibernet may revise these Terms periodically to reflect changes in services, plans, technologies, business practices, or applicable legal and regulatory requirements.

Updated Terms may be published on our website and will take effect in accordance with applicable requirements.

24. Governing Law

These Terms shall be governed by the laws of India.

Any disputes shall be subject to applicable statutory and regulatory dispute-resolution mechanisms and, where legally permissible, the jurisdiction of competent courts in Tiruchirappalli, Tamil Nadu.
